Matching (Siding/Roofing) Partial Denial
Dear {{named_insured}},
1. Context We are pleased to inform you that we have approved your claim for hail damage to your siding at {{loss_location_address}}, reported under claim number {{claim_number}} for the date of loss {{date_of_loss}}. This letter explains how we calculated your payment for these repairs.
2. The Decision We have issued a payment for the replacement of the damaged siding panels on the {{damaged_side_elevation}} elevation of your property. However, we have denied your request to replace all siding panels on the other, undamaged elevations of your home, even though the new panels may not perfectly match the existing, weathered siding.
3. The Evidence Our inspection confirmed that hail caused direct physical loss to {{damaged_panel_count}} siding panels on the {{damaged_side_elevation}} elevation. The siding on the other three elevations remains intact and was not damaged by the hail event. Our estimate includes the cost to replace only the damaged panels with new siding of similar kind and quality.
4. The Policy Basis Your policy, number {{policy_number}}, is a replacement cost policy that covers "direct physical loss" to your property. The relevant provision states:
> Section I - Losses We Cover > We will pay for direct physical loss to property described in Coverages A and B... > > Replacement Cost Provisions > We will pay the cost to repair or replace the damaged property with material of like kind and quality...
Under this policy language, our obligation is to repair or replace only the property that sustained direct physical damage. We are not required to replace undamaged property for the sole purpose of achieving a uniform appearance or "matching." Because only the {{damaged_side_elevation}} elevation was damaged, our payment is limited to the repair of that elevation.
5. The Path Forward If you believe there is direct physical damage to other elevations that we missed during our inspection, please let us know immediately so we can schedule a re-inspection. Otherwise, you may proceed with the repairs to the damaged elevation using the payment provided. If you have any further questions, please contact {{adjuster_name}} at {{adjuster_phone_number}}.
